Welcome to ESA Right Away. These Terms of Service ("Terms") are a legal agreement between you and ESA Right Away ("Company," "we," "us," or "our"). They cover your use of our website at esarightaway.com and our services.
PLEASE READ THESE TERMS CAREFULLY. By using our Services, you agree to these Terms. If you do not agree, please do not use our Services.
1. What We Do
1.1 Our Services
ESA Right Away is a referral platform. We connect you with local mental health clinics that have licensed providers. These providers do evaluations and write ESA letters when appropriate.
Our Services include:
- A website to request an ESA letter evaluation
- Connecting you with a licensed provider at a local clinic
- Helping you schedule your evaluation
- Delivering your ESA letter if approved
- Customer support
1.2 What We Do NOT Do
- We do not provide mental health treatment. The evaluation is only for ESA letter purposes.
- We do not guarantee approval. The provider decides if an ESA letter is right for you.
- We do not give legal advice. We cannot tell you what to do if your landlord has questions.
- We do not talk to your landlord. You handle all contact with your landlord.
1.3 About the Providers
The licensed mental health providers who do evaluations work at clinics we partner with. Some may be employees and some may be contractors. Each provider holds a valid license in your state. The provider makes their own clinical decisions. We do not tell them what to decide.
2. Who Can Use Our Services
To use our Services, you must:
- Be at least 18 years old
- Live in a state where we have providers
- Give us true and complete information
- Have a real need for an ESA evaluation
3. The Evaluation Process
3.1 How It Works
You fill out a form with info about yourself and your mental health. A licensed provider reviews your info. They may contact you for more details. Then they decide if an ESA letter is right for you.
3.2 No Guaranteed Outcome
We cannot promise you will get an ESA letter. The provider makes that choice based on their professional judgment. If they say no, you will not get a letter.
4. Fees and Payment
4.1 Our Prices
- Standard ESA Letter: $75
- Custom ESA Letter: $125
- Each Additional Pet (Standard): $50
- Each Additional Pet (Custom): $75
4.2 Payment
You pay when you submit your request. We use secure payment processing. All prices are in US dollars.
5. Refund Policy
IMPORTANT: PLEASE READ THIS SECTION VERY CAREFULLY.
ALL SALES ARE FINAL. NO REFUNDS WILL BE ISSUED UNDER ANY CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO:
(a) DENIAL OF YOUR ESA LETTER REQUEST. If the licensed provider determines, in their sole and absolute clinical discretion, that you do not qualify for an Emotional Support Animal letter, or that issuance of such letter would not be clinically appropriate, YOU WILL NOT RECEIVE A REFUND. You are paying for a professional evaluation, not a guaranteed outcome. The evaluation fee is earned upon submission of your request and commencement of the evaluation process, regardless of the final determination.
(b) LANDLORD REJECTION. If your landlord, property manager, housing provider, homeowners association, or any other third party refuses to accept, honor, or acknowledge your ESA letter for any reason whatsoever, YOU WILL NOT RECEIVE A REFUND. We make no representations, warranties, or guarantees regarding third-party acceptance of ESA letters.
(c) CHANGE OF MIND. If you change your mind, no longer need an ESA letter, move to a different residence, rehome your animal, or for any other reason no longer wish to proceed, YOU WILL NOT RECEIVE A REFUND.
(d) DISSATISFACTION WITH SERVICES. Your subjective dissatisfaction with any aspect of our Services, including but not limited to wait times, communication, or the evaluation process, DOES NOT ENTITLE YOU TO A REFUND.
BY SUBMITTING PAYMENT, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU HAVE READ, UNDERSTAND, AND ACCEPT THIS NO-REFUND POLICY IN ITS ENTIRETY.
5.1 Limited Exceptions
We may, in our sole discretion, consider refund requests only if:
- You paid twice by mistake (duplicate charge)
- We charged the wrong amount due to a system error
To request review of a billing error, email [email protected] within 7 days of payment.
6. Your Promises to Us
When you use our Services, you promise that:
- All info you give us is true and complete
- You are seeking an ESA letter for a real mental health need
- You will not lie to get a letter
- You will not change or fake your ESA letter
- You will use the letter only for yourself
- You understand an ESA is not the same as a service animal
Fraud Warning: Lying to get an ESA letter may be fraud. It could lead to civil or criminal penalties. We may report suspected fraud to the proper authorities.
7. Things You Cannot Do
You agree NOT to:
- Give false info
- Pretend to be someone else
- Use our Services for anything illegal
- Try to hack or break our website
- Copy or sell ESA letters from us
- Be rude or harmful to our staff or providers
8. ESA Letters and Housing Rights
8.1 What an ESA Letter Does
An ESA letter from a licensed provider may help you request housing with your emotional support animal under the Fair Housing Act. This federal law says landlords must make reasonable changes for people with disabilities.
8.2 What You Need to Know
- An ESA is NOT the same as a service animal
- ESAs do not have the same public access rights as service animals
- Some housing may be exempt from the Fair Housing Act
- Landlords can ask for paperwork and may have questions
- We cannot force a landlord to accept your letter
- State and local laws may differ
8.3 Not Legal Advice
Nothing we say is legal advice. If you have legal questions or face problems with your landlord, please talk to a lawyer or contact HUD (U.S. Department of Housing and Urban Development).
9. Our Content
Everything on our website belongs to us or our partners. This includes text, images, logos, and code. You may not copy, share, or sell our content without written permission.
10. No Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- Our Services will work without errors or interruptions
- Any ESA letter will be accepted by your landlord
- Our website info is always complete or current
- Our Services will meet your specific needs
11. Limits on Our Liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, ESA RIGHT AWAY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES LOST PROFITS, LOST DATA, OR OTHER LOSSES ARISING FROM YOUR USE OF OUR SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS RELATED TO THESE TERMS OR OUR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.
THESE LIMITS APPLY EVEN IF WE KNEW ABOUT THE POSSIBILITY OF SUCH DAMAGES.
12. You Protect Us
You agree to defend and protect ESA Right Away and its owners, officers, employees, and partners from any claims, losses, or costs (including lawyer fees) that come from:
- Your use of our Services
- Your breach of these Terms
- False info you gave us
- Any dispute between you and your landlord about your ESA
13. Solving Disputes
13.1 Talk to Us First
Before taking legal action, please email us at [email protected] to try to work things out. We will try to respond within 30 days.
13.2 Arbitration
If we cannot solve a dispute informally, you and ESA Right Away agree to use binding arbitration instead of going to court. Arbitration will follow the rules of the American Arbitration Association (AAA). The arbitration will take place in Nevada.
13.3 No Class Actions
YOU AGREE TO BRING CLAIMS ONLY AS AN INDIVIDUAL, NOT AS PART OF A CLASS OR GROUP LAWSUIT.
13.4 Governing Law
These Terms follow the laws of the State of Nevada.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will:
- Post the new Terms on our website
- Update the "Last Updated" date
By continuing to use our Services after changes, you accept the new Terms.
15. Ending Your Use
We may stop letting you use our Services at any time if we think you broke these Terms. If that happens, you lose access to our Services right away.
16. Other Legal Points
16.1 Whole Agreement
These Terms and our Privacy Policy are the full agreement between you and us about our Services.
16.2 If Part Is Invalid
If a court says part of these Terms is not valid, the rest still applies.
16.3 No Waiver
If we do not enforce a rule once, we can still enforce it later.
16.4 Transfer
You cannot give your rights under these Terms to someone else. We can transfer our rights.
